Terms of Service

Please read these Terms of Service ("Terms") carefully before using ECG Mastery (the "App"). By creating an account or using the App, you agree to be bound by these Terms.

1. Description of Service

ECG Mastery is an educational and clinical reference application designed to support healthcare professionals, residents, and medical trainees in ECG interpretation and exam preparation. The App provides reference material, training content (Qbank), educational order set templates for study and reference purposes, and a drug reference library. The App does not perform diagnosis, does not generate patient-specific recommendations, and is not intended to be used as a real-time decision-making tool during patient care; all content is general educational reference material that the user must independently interpret and verify.

2. Not a Substitute for Clinical Judgment

ECG Mastery is intended as an educational and clinical reference tool to support — not replace — the judgment of a qualified healthcare professional. The App does not provide medical advice, diagnosis, or treatment, is not patient-specific, and must not be used as the sole basis for any patient care decision. All order set templates, drug reference content, and clinical scenarios are general educational materials only and must be independently verified against current clinical guidelines, your institution's protocols, and your own clinical judgment before any application to an actual patient. Always follow your institution's protocols and use independent clinical judgment when making patient care decisions. We assume no liability for clinical decisions made using information from the App.

3. Eligibility

The App is intended for use by licensed healthcare professionals, residents, medical students, and trainees who are 18 years of age or older. By using the App, you confirm that you meet this requirement.

4. Account Registration

To access certain features, you must create an account using a valid email address. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

5. Subscription Plans & Billing

• The App offers a Free plan with limited access, and paid subscription plans (Monthly, 3-Month, and 6-Month) that unlock full access to the Qbank, Order Sets, and Clinical Scenarios modules.
• All paid subscriptions are billed through Google Play Billing and are subject to Google Play's own payment terms.
• Subscriptions renew automatically at the end of each billing cycle unless cancelled before the renewal date. You can manage or cancel your subscription at any time through your Google Play account settings.
• Upon cancellation, you will retain access to paid features until the end of your current billing period.

6. Refund Policy

If you are not satisfied with your subscription, you may request a refund within 7 days of your initial purchase by contacting us through the support channels listed below. Refund requests made after this period will be reviewed on a case-by-case basis at our discretion. Refunds for renewal payments (i.e., not your first purchase) are subject to Google Play's refund policies, and we recommend requesting these directly through Google Play.

7. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of these Terms;
• Attempt to copy, reverse-engineer, resell, or redistribute the App's content;
• Share your account credentials with others or use the App to provide services to third parties.

8. Intellectual Property

All content within the App — including ECG tracings, order set templates, drug reference content, Qbank questions, and explanations — is the intellectual property of ECG Mastery and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works from this content without our prior written consent.

9. Disclaimer of Warranties

The App is provided "as is" and "as available," without warranties of any kind, whether express or implied. We do not warrant that the App will be error-free, uninterrupted, or that the content is appropriate for every clinical situation or jurisdiction.

10. Limitation of Liability

Our liability for damages arising from simple (ordinary) negligence shall be limited to foreseeable damages typical for contracts of this kind, and only where we have breached a material contractual obligation (i.e., an obligation whose fulfilment is essential to the proper performance of the App and on which you are entitled to rely). Liability for all other cases of simple negligence is excluded.

These limitations do not apply to, and nothing in these Terms limits or excludes, our liability for: (a) death or personal injury; (b) intentional misconduct or gross negligence; (c) fraudulent misrepresentation; or (d) any other liability that cannot be limited or excluded under applicable mandatory law, including product liability law.

We do not warrant the clinical accuracy, completeness, or currency of any content for use in an actual patient encounter. As set out in Section 2, all order sets, drug reference content, and clinical scenarios are educational reference material only; final responsibility for any patient care decision rests solely with the treating healthcare professional.

11. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless ECG Mastery and its team from any third-party claims, liabilities, damages, losses, and reasonable legal costs arising out of: (a) your use of App content directly in patient care in a manner inconsistent with Section 2 (Not a Substitute for Clinical Judgment); (b) your violation of these Terms; or (c) your violation of any applicable law or the rights of a third party. This indemnification obligation does not apply where the underlying claim results from our intentional misconduct, gross negligence, or from death, personal injury, or other liability that cannot be excluded under Section 10.

12. Termination

We reserve the right to suspend or terminate your account if you violate these Terms or use the App in a way that could harm other users or the App itself.

13. Governing Law

These Terms shall be governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. If you are using the App as a consumer, this choice of law does not deprive you of the protection afforded by any mandatory provisions of the law of the country in which you have your habitual residence. Any dispute arising out of or relating to these Terms shall be subject to the courts having jurisdiction over our registered place of business, except where mandatory consumer-protection law entitles you to bring proceedings before the courts of your own place of residence instead.

14. Severability

If any provision of these Terms is or becomes invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be deemed replaced by a valid provision that most closely reflects the economic intent of the original provision, to the extent permitted by law.

15. Changes to These Terms

We may revise these Terms from time to time. We will update the "Last updated" date above when changes are made. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.
